1. Acceptance of Terms

Welcome to New Brighton Dispensary. By accessing our premises, using our services, or purchasing products from us, you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and New Brighton Dispensary, located at 445 Old Highway 8 NW, Suite 103, New Brighton, MN 55112.

By using our services, you acknowledge that:

  • You have read, understood, and agree to comply with these Terms
  • You meet all eligibility requirements outlined herein
  • You will comply with all applicable federal, state, and local laws
  • You understand the risks associated with cannabis use

If you do not agree with any part of these Terms, you must not use our services or purchase our products. Your continued use of our services constitutes acceptance of any modifications to these Terms.

2. Eligibility Requirements

Age Verification Required

You must be at least 21 years of age to enter our premises, use our services, or purchase cannabis products. We strictly enforce age verification policies in compliance with Minnesota state law.

Required Documentation

All customers must present valid, government-issued photo identification before entering our dispensary or making any purchases. Acceptable forms of identification include:

  • Valid state-issued driver's license
  • State identification card
  • United States passport
  • Military identification card
  • Foreign passport (for international visitors)

Additional Requirements

You certify that you:

  • Are legally permitted to purchase and possess cannabis under Minnesota state law
  • Will not resell, distribute, or transfer purchased products to minors
  • Will consume cannabis products only in legal locations
  • Do not intend to transport cannabis products across state lines
  • Are not prohibited from purchasing cannabis due to legal restrictions

New Brighton Dispensary reserves the right to refuse service to any individual who cannot provide valid identification, appears to be intoxicated, or violates our policies.

3. Purchases & Transactions

Possession Limits

Minnesota law establishes specific possession limits for cannabis products. You may not purchase or possess quantities exceeding:

  • 2 ounces of cannabis flower in public places
  • 8 grams of cannabis concentrate
  • 800 milligrams of THC in edible products (combined total)
  • 2 pounds of cannabis flower at your private residence

Payment Methods

We accept the following payment methods:

  • Cash
  • Debit cards
  • ATM on-site for customer convenience

Due to federal banking restrictions, we do not accept credit cards at this time. All sales are final once completed.

Pricing & Taxes

All prices are subject to change without notice. Minnesota applies a 15% cannabis excise tax in addition to applicable state and local sales taxes. Prices displayed in-store and on receipts include all applicable taxes unless otherwise noted.

Medical cannabis patients registered with Minnesota's medical cannabis program are exempt from the cannabis excise tax but must present valid medical cannabis registry identification.

Returns & Refunds

All sales are final. Due to the nature of cannabis products and health regulations, we cannot accept returns or provide refunds on any purchased items. We encourage customers to ask questions and review products carefully before completing purchases.

4. Product Information & Warnings

Product Accuracy

We strive to provide accurate information about all products, including THC/CBD content, terpene profiles, effects, and usage instructions. However:

  • Product information is provided for educational purposes only
  • Individual experiences may vary significantly
  • We make no guarantees about specific effects or outcomes
  • Testing results represent samples and may have slight variations

Health & Safety Warnings

Important Health Information

Cannabis products can impair your ability to drive or operate machinery. Do not drive, operate heavy equipment, or engage in hazardous activities while under the influence of cannabis.

Keep all cannabis products out of reach of children and pets. Accidental ingestion can be dangerous.

Consult your healthcare provider before using cannabis if you are pregnant, nursing, taking medications, or have underlying health conditions.

Start Low, Go Slow

New users should begin with low doses and wait adequate time before consuming more. Effects can take 30 minutes to 2 hours for edibles, and individual tolerance varies greatly. Overconsumption can lead to uncomfortable experiences.

Product Storage

Proper storage is your responsibility. Store all cannabis products:

  • In original, child-resistant packaging when possible
  • In cool, dry locations away from direct sunlight
  • Secured and inaccessible to children and pets
  • Separated from food items to prevent accidental consumption

5. Legal Compliance & Restrictions

Minnesota Cannabis Laws

You agree to comply with all Minnesota cannabis laws and regulations, including but not limited to:

  • Consumption Restrictions: Cannabis may only be consumed in private residences (with property owner permission), private property, and other legally permitted locations
  • Public Use Prohibitions: Cannabis is prohibited in schools, correctional facilities, federal property, Minneapolis parks, all indoor public spaces, multifamily housing units (except medical patients), and motor vehicles
  • Impaired Driving: Driving under the influence of cannabis is illegal and subject to criminal penalties including fines, license suspension, and imprisonment
  • Open Container Laws: Cannabis products must be transported in sealed, unopened containers

Federal Law Reminder

Federal vs. State Law

Cannabis remains illegal under federal law. While Minnesota has legalized recreational cannabis, federal law still classifies it as a controlled substance. This creates important restrictions:

  • Cannabis is prohibited on all federal property (airports, national parks, federal buildings, post offices)
  • Transporting cannabis across state lines is a federal crime, even between legal states
  • Federal employees may be subject to drug testing and termination
  • Cannabis businesses have limited access to traditional banking services

Interstate Transportation Prohibition

Never transport cannabis across state lines. This is a serious federal offense punishable by criminal prosecution, regardless of the legal status in either state. Consume all purchased cannabis within Minnesota.

Workplace Policies

Legal cannabis use does not prevent employers from maintaining drug-free workplace policies, conducting drug testing, or taking adverse employment actions based on cannabis use. Many employers prohibit cannabis use regardless of state legalization.

6. Privacy & Data Protection

Information Collection

We collect personal information necessary to verify age, complete transactions, and comply with Minnesota cannabis regulations. This includes:

  • Name, date of birth, and address from identification
  • Purchase history and transaction details
  • Contact information (if voluntarily provided)
  • Medical cannabis registry information (for registered patients)

Data Use & Protection

Your information is used solely for:

  • Age verification and legal compliance
  • Processing purchases and transactions
  • Regulatory reporting as required by Minnesota law
  • Customer service and support

We do not sell, rent, or share your personal information with third parties except as required by law or necessary to process transactions. All data is stored securely using industry-standard encryption and security measures.

Data Retention

We retain customer data in accordance with Minnesota cannabis regulations and dispose of it securely when no longer needed for legal compliance or business purposes.

Your Privacy Rights

You have the right to:

7. Prohibited Activities

You agree NOT to engage in any of the following prohibited activities:

Illegal Actions

  • Purchasing cannabis with intent to resell or distribute
  • Providing cannabis to anyone under 21 years of age
  • Using false or fraudulent identification
  • Attempting to exceed legal possession limits
  • Transporting cannabis across state lines
  • Consuming cannabis in prohibited locations
  • Driving while impaired by cannabis

Disruptive Behavior

  • Threatening, harassing, or abusive conduct toward staff or customers
  • Entering the premises while visibly intoxicated
  • Consuming cannabis products on our premises
  • Loitering or creating disturbances
  • Recording staff or customers without consent
  • Bringing weapons or illegal substances onto the premises

Consequences

Violation of these prohibitions may result in:

  • Immediate removal from premises
  • Permanent ban from our dispensary
  • Reporting to law enforcement if criminal activity is suspected
  • Legal action for damages or injuries caused

8. Limitation of Liability & Disclaimers

Assumption of Risk

By purchasing and consuming cannabis products, you acknowledge and accept the inherent risks associated with cannabis use, including but not limited to:

  • Impairment of cognitive and motor functions
  • Adverse psychological reactions (anxiety, paranoia)
  • Respiratory effects from smoking
  • Potential drug interactions with medications
  • Varying individual tolerance and sensitivity
  • Unpredictable effects from overconsumption

No Medical Claims

Disclaimer: Cannabis products sold at New Brighton Dispensary are not FDA-approved and are not intended to diagnose, treat, cure, or prevent any disease. Product information, including potential effects and benefits, is provided for educational purposes only and does not constitute medical advice.

Always consult qualified healthcare professionals before using cannabis, especially if you have underlying health conditions, are pregnant or nursing, or are taking prescription medications.

Limitation of Liability

To the fullest extent permitted by Minnesota law, New Brighton Dispensary, its owners, employees, and affiliates shall not be liable for:

  • Adverse reactions, side effects, or injuries resulting from cannabis use
  • Damages arising from misuse, improper storage, or overconsumption of products
  • Consequences of driving or operating equipment while impaired
  • Legal consequences resulting from your violation of cannabis laws
  • Employment actions taken by employers due to cannabis use
  • Indirect, incidental, consequential, or punitive damages

Maximum Liability: In no event shall our total liability exceed the purchase price of the product(s) in question.

Indemnification

You agree to indemnify and hold harmless New Brighton Dispensary from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, applicable laws, or misuse of cannabis products.

9. Changes to Terms & Conditions

New Brighton Dispensary reserves the right to modify, update, or replace these Terms and Conditions at any time without prior notice. Changes become effective immediately upon posting.

Notice of Changes

Material changes to these Terms will be communicated through:

  • Updated "Last Updated" date at the top of this page
  • In-store signage when appropriate
  • Email notification (if you have provided contact information)

Continued Use

Your continued use of our services or purchase of products after changes to these Terms constitutes your acceptance of the modified Terms. We encourage you to review this page periodically to stay informed of any updates.

Disagreement with Changes

If you do not agree with modified Terms, you must discontinue using our services immediately. Continued use indicates acceptance of all changes.

10. General Provisions

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of Ramsey County, Minnesota.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of New Brighton Dispensary.

Entire Agreement

These Terms constitute the entire agreement between you and New Brighton Dispensary regarding the use of our services and supersede all prior agreements, communications, and understandings, whether written or oral.

Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder. We may assign our rights and obligations under these Terms without restriction.

Age Verification Acknowledgment

By accepting these Terms, you certify under penalty of perjury that you are at least 21 years of age and legally permitted to purchase and possess cannabis products under Minnesota state law.
